Please read these Terms of Service (“Terms”) carefully before using BAT’s website, client portal, community, or engaging BAT for any project or service.
By accessing our website, submitting an inquiry, using our client systems, or purchasing services from BAT, you agree to these Terms. If you do not agree, please discontinue use of our services and website.
Every website or web application delivered by BAT includes a 12-month support warranty starting from the official launch date.
If an issue is directly caused by our delivered work — including bugs, broken layouts, or features not functioning as originally agreed — BAT will make commercially reasonable efforts to resolve the issue at no additional cost during the warranty period.
After the warranty period ends, support, maintenance, and fixes remain available for a reasonable maintenance fee agreed upon in advance.
What the warranty covers
- Bugs or errors in code and layouts delivered by BAT.
- Functionality that stops working without unauthorized modification to delivered files.
- Reasonable compatibility fixes related to major browser updates during the warranty period.
What the warranty does not cover
- Issues caused by edits, modifications, or installations performed by the client or third parties without BAT approval.
- Hosting, server, domain, SSL, DNS, email, or third-party provider outages.
- Paid plugin renewals, API billing problems, or external service failures.
- New features, redesigns, additional pages, or scope changes requested after approval.
- Content supplied by the client including text, images, trademarks, logos, or legal compliance obligations.
- Force majeure events or circumstances beyond reasonable operational control.
Warranty response times
Support requests are typically reviewed within 2–5 business days depending on request volume and severity.
Emergency or same-day support may require additional fees unless explicitly included in the project agreement.
After the warranty period
After the 12-month warranty expires, clients may continue requesting updates, maintenance, or technical support.
BAT will provide a maintenance quote based on the scope and complexity of the requested work. Maintenance pricing is generally lower than new project pricing unless major redevelopment is required.
Work begins only after written approval from the client through email, portal confirmation, or another approved communication channel.
Agency Credit on Client Websites
Unless otherwise agreed in writing, projects built by BAT may include a small and discrete footer credit such as:
“Designed & Developed by BAT”
The credit may contain a link to BAT’s official website (e.g. bat-eg.pages.dev).
- The client agrees to keep this credit visible and clickable for at least 12 months after launch, unless removed through mutual written agreement.
- If specified in the project agreement, early removal of the credit may require a one-time credit removal fee.
- BAT may showcase completed projects, business names, screenshots, and publicly accessible URLs within its portfolio, marketing materials, and case studies unless the client requests otherwise in writing before project launch.
Services & Project Agreements
BAT provides web design, web development, UI/UX design, branding support, client systems, and related digital services.
Project scope, pricing, timelines, milestones, and deliverables are defined in the proposal, invoice, quotation, or statement of work provided to the client.
These Terms apply alongside any signed agreement. If a conflict exists between these Terms and a signed project document, the signed project agreement takes precedence for that project.
Payments
- Deposits and milestone payments must be paid according to the approved quotation or invoice.
- Late payments may pause project work, support, or delivery timelines.
- BAT reserves the right to suspend unpublished work or restrict access to project files for invoices overdue by more than 30 days.
- Third-party expenses including hosting, domains, stock assets, premium plugins, or external subscriptions are the client’s responsibility unless explicitly included in writing.
Revisions & Scope Changes
- Projects include the revision rounds specified in the quotation or agreement.
- Additional revisions, large design changes, or requests outside the approved scope may require additional fees.
- Requests submitted after approval of a completed phase may be treated as new work and quoted separately.
- The client agrees to provide timely feedback, approvals, content, and required assets. Delays from the client side may affect delivery schedules.
Intellectual Property
Upon full payment, the client receives ownership or usage rights for the final approved deliverables as outlined in the project agreement.
BAT retains ownership of:
- Internal processes
- Development methods
- General techniques
- Reusable components
- Non-confidential know-how
Pre-existing libraries, frameworks, and open-source software remain governed by their original licenses.
Editable source files, repositories, design files, or development assets are only included if explicitly stated in the project agreement.
BAT may use subcontractors, external tools, or trusted service providers when necessary to complete project work.
Until full payment is received, BAT may withhold project launch, credentials, source files, or administrative access.
